Court Awards $2,500 to Westwood Attorney For Junk Faxes

Joseph Oettinger sued three companies which sent him unsolicited faxes.

New Jersey Superior Court judges awarded a total of $2,500 to a Westwood-based attorney for receiving unwanted "junk faxes."

Joseph Oettinger sued QB Training SolutionsCasa Maselli Pizzeria and Stevens Commercial Roofing for sending him "unsolicited fax advertisements." He alleged the companies violated the federal Telephone Consumer Protection Act and the New Jersey Junk Fax Act by sending him the faxes.

Courts had previously ruled that QB Training Solutions should pay Oettinger $500 and Casa Maselli should pay him $1,000, but did not award any lawyer fees because Oettinger represented himself.

Oettinger appealed the lack of lawyer fees. In two new decisions issued Wednesday, superior court judges again declined to award lawyer fees to Oettinger for the two suits.

In a third suit, Oettinger appealed a previous decision that had dismissed his case against Stevens because he "needed to prove that he was tangibly harmed by the unwanted faxes." The judges ruled Wednesday that Stevens should pay Oettinger $1,000, but again declined to award him lawyer fees.

Oettinger could not immediately be reached for comment.
